Powell & Majestro played a critical role on the Law & Briefing Committee, with Anthony Majestro serving as a Co-Chair. In addition to their primary work on Law & Briefing, Powell & Majestro attorneys played a significant role in New Mexico, Michigan, and Nevada, recruiting experts, developing the abatement case, briefing (prior, during and post-trial) and being members of the New Mexico and Nevada trial team.
Mr. Majestro has been involved in leadership roles in the opioid litigation nationwide serving as Co-Chair of the Law and Briefing Committee of MDL 2804, In re: National Prescription Opiate Litigation, which the Washington Post has called “the largest and most complex case in the history of jurisprudence.” Powell & Majestro’s attorneys have been involved in developing the novel and complex legal theories utilized in the case as well as in state cases around the country, including leading the team drafting the bellwether cases against the Pharmacy Benefits Managers (PBMs).

- National Opioid Settlements:
- Distributors McKesson, Cardinal Health, and AmerisourceBergen will collectively pay $21 billion over 17 years, which is to be used exclusively on abatement programs designed to combat the opioid crisis, which has been estimated to cost the United States over $1 trillion from 2001 to 2017;
- Johnson & Johnson will pay an additional $5 billion over the next six years;
- Teva will pay up to $3.34 billion over 13 years and provide either $1.2 billion of its generic version of the drug Narcan over 10 years or $240 million of cash in lieu of product;
- Allergan will pay up to $2.02 billion over 7 years;
- CVS will pay up to $4.90 billion over 10 years;
- Walgreens will pay up to $5.52 billion over 15 years; and
- Walmart will pay up to $4.74 billion with 6 years.
- As Special Assistant Attorney General Counsel for the State of West Virginia – $3 million in debt relief and other payments along with significant injunctive relief against sub-prime cred card bank.
- $20 million insurance policy limit settlement in an admiralty mass tort action in which Powell & Majestro, LLC represented individuals and the Ohio Department of Transportation.
- $151 million settlement in a class action on behalf of approximately 250,000 residents and businesses who suffered damages from contamination of the water supply.
- Successfully defended on appeal $20 million in plaintiffs’ verdicts arising out of the vaginal mesh MDL.
- Successfully defended a multi-million-dollar verdict awarded as a result of injuries sustained by a worker in a work-related incident.
The firm has recently been retained by the West Virginia State Auditor and West Virginia PEIA to pursue claims against the insulin manufacturers and PBMs for artificially inflating the price of insulin at the expense of self-funded health plans and the members and beneficiaries. The suit seeks monetary damages and disgorgement for the excessive insulin prices resulting from violations of deceptive and unfair trade practices, unjust enrichment and breach of contract, among other potential claims.
The firm is currently representing residents of Charleston’s West Side in the ongoing litigation related to the November 2023 water and gas utility outages that left thousands of residents to endure freezing temperatures without heat, gas, or water over the Thanksgiving holiday.
