Age Of The Debt
The age of the debt is a factor in consumer debt collection law. Credit card companies, for example, have a five-year time limit to collect your debt in the state of West Virginia. If the debt is not collected within this statute of limitations, the debt collector cannot use the court to attempt to collect. You may still need representation by an attorney, however, because even though the debt collectors are barred from suing you, they are still allowed to request payment.
