Fair Debt Collection

Pioneers In Protecting Consumer Rights

Consumers are sometimes harassed by unscrupulous debt collection agencies that send offensive or threatening letters, talk to neighbors and family, freeze credit, attempt to collect penalties, or worse. The attorneys at Powell & Majestro P.L.L.C. are pioneers in the protection of debtors’ rights.

We are one of only a few firms that litigate this type of case in the state of West Virginia. We even teach other attorneys how to defend debtors who are unfairly subject to the collection of a debt or illegal debt collection practices.

Protecting Your Consumer Rights

Stringent rules and regulations created by the Federal Trade Commission and the State of West Virginia restrict the behavior of debt collectors and protect you. These statutes apply if you are late in paying various household debts such as mortgages, auto loans, credit card bills, medical bills and more. Powell & Majestro P.L.L.C. knows how to make the debt collectors adhere to these rules. We fight vigorously for your rights under statutes such as the Fair Debt Collection Practices Act and the West Virginia Consumer Credit and Protection Act. On your behalf, we sue banks, credit unions, credit card companies and other creditors for compensatory and punitive damages when appropriate.

Tireless Advocates Give You Peace Of Mind

Debt collectors are supposed to follow the letter of the law when attempting to collect. By hiring Powell & Majestro P.L.L.C., you can be sure that your rights as a consumer are protected and the debt collector is forced to follow the law. Debt collectors are no longer allowed to communicate with you or anyone else about your debt. They have to deal with us directly, and we protect your rights.

Acting On Prohibited Behaviors

Call us at 304-346-2889 if you have been threatened by a debt collector who is abusive or uses any of the following prohibited behaviors:

  • Misleading representations
  • Invasion of privacy
  • Arrest
  • Garnishment of wages without a judicial order
  • Obscene or abusive language
  • Violence or threat of violence
  • Publication of your name
  • Harassing phone calls
  • Deceptive behavior
  • Communicating with your employer
  • Coercion
  • Failure to provide an accounting of money collected
  • Harm to your reputation or property

Age Of The Debt

The age of the debt is a factor in consumer debt collection law. Credit card companies, for example, have a five-year time limit to collect your debt in the state of West Virginia. If the debt is not collected within this statute of limitations, the debt collector cannot use the court to attempt to collect. You may still need representation by an attorney, however, because even though the debt collectors are barred from suing you, they are still allowed to request payment.
