The Evidence

Documents obtained in discovery indicate J&J was aware of the presence of asbestos – a known carcinogen – in its talc. Specifically, a confidential memo from 1969 made public during one of the trials reveals a J&J research scientist noting that tests found asbestos in talc used in the baby powder. The scientist went on to warn the health care company that they should prepare for litigation if the information ever became public.

This evidence is one of the reasons that juries have returned substantial verdicts.

Holding J&J Accountable

Our Talc Litigation team has partnered with other law firms around the country to try seven ovarian cancer cases since February 2016. We have obtained favorable verdicts on behalf of five plaintiffs totaling more than $724 million.

Recently, a California state jury awarded the family of a woman who died from mesothelioma $29.5 million after finding J&J's talcum powder products contain asbestos. In July 2018, another jury held Johnson & Johnson and its talc supplier, Imerys Talc America, liable for a man's mesothelioma and awarded him $177 million.

In light of the numerous claims that involved providing J&J with talc, the mining company filed for bankruptcy protection in February 2019.
